Terms and Conditions
Please read these conditions carefully prior to making a booking. The terms are limited to the Diamond on the Island and do not apply to terms and conditions in relation to any other person or company whose services are used by you or your party on any holiday.
Making a booking
The completed booking form showing the names of all persons on whose behalf you are making a booking must be completed by the party leader. The person completing the booking form confirms that he/she has the authority of all other persons included on the booking form to make the booking on their behalf and that he/she has read and accepted these booking conditions. A NON-REFUNDABLE deposit of $400 for your reservation is required at the time of booking. For bookings of holiday periods, deposit amounts may vary. Deposits are accepted as partial payment towards the total cost of the reservation. Upon receipt by the Diamond on the Island of your completed booking form and deposit, we will reserve your nights. It is important to check the details on the invoice and that all the dates are exactly as you requested. The Diamond on the Island responsibility is to provide you with the holiday you have booked as confirmed to you and subject to these booking conditions. If you want to cancel or change your booking, you may have to pay amendment or cancellation costs which may be as much as the total holiday cost. Promotional discounts are occasionally created and advertised in several places to encourage NEW guests to try our home and realize the tremendous benefits of renting our home. Guests who have previously rented our home are ineligible for these NEW guest promotional discounts. Under no conditions will we allow two promotional discounts on any one reservation.
Security deposits
A financial security deposit is not required. Credit card information will be taken to ensure the owner has an option in the event of property damages or to replace missing items.
Paying the balance
Balances are payable in full 60 days before check-in. For bookings within 60 days of check-in, the total rental amount is payable at the time of booking. If payment of the balance of the price of the holiday is not received by the Diamond on the Island by the due date, the Diamond on the Island reserves the right to cancel the booking for the holiday in which case the Diamond on the Island is entitled to keep all deposits paid in respect of the reservation. The Diamond on the Island reserves the right to raise or lower its prices at any time before you book your holiday. You will be advised at the time of booking as to the current price. Once you have booked and confirmation has been sent, the price of the holiday is guaranteed except that the Diamond on the Island may pass on to you, and you will have to pay, any tax, duty, levy or any increase in such tax, duty or levy that is charged by any government or other authority after the date your booking is confirmed and accepted.
Changes by Diamond on the Island
All descriptions are made in good faith and every care is taken to ensure their accuracy and the advertised facilities, amenities, entertainment and schedules may on occasion be restricted, curtailed, changed or cancelled. In these circumstances, we will, if possible, notify you of such changes. Advertised facilities may vary from those published. We will always try to advise you in advance of any changes before the holiday begins but cannot accept any liability to changes by owners or management companies to advertised facilities for property or accommodation.
Cancellations
Your cancellation can only be accepted if it is in writing or by email from the person who completed the booking form. Cancellation will be effective from the date it is received and acknowledged. You may cancel your booking at any time. Cancellation charges will apply as follows. Cancellations more than 90 days before the arrival date the deposit will be forfeited. If the balance of payment is not made in full 90 days prior to the commencement of the rental, we reserve the right to cancel the booking and the deposit will be forfeited in lieu of a formal cancellation request. If cancelled between 6 and 8 weeks before the arrival date at the property, 50% of the full fee will be forfeited. If cancelled between 4 and 6 weeks before the arrival date at property, 75% of the full fee will be forfeited. Cancellation within 4 weeks of arrival date will result in full forfeiture of the rental fee.
Responsibilities
It is the responsibility of all persons listed on the party details form to ensure that all equipment and furnishings within the home are treated with respect and due care. It is the guests responsibility to ensure that the security alarm is used whenever the home is left unoccupied and that all windows and doors are locked. Failure to follow these requirements will result in the guests being liable for losses as the result of burglary. Any spillages on carpets or furnishings must be cleaned immediately. It is expected that on your departure day all furnishings and equipment will be left in a reasonably clean condition.
If you are using the house on Wednesday or Sunday night, you should put the garbage cans out to the curb that night. Garbage collections are on Monday and Thursday mornings about 6:00 am. If you have an accumulation of garbage greater than what will fit in the garbage cans at your departure time, please take the excess to the compactor. Failure to remove the excess garbage from the house will result in a financial charge of possibly $50.
Complaints Procedure
If you have a complaint while you are on holiday, you must tell the Management Company immediately. They will do their best to resolve any problem to your satisfaction on the spot. In the unlikely event that any complaint cannot be settled quickly, you should contact the Diamond on the Island. Claims in respect of accommodation are limited to the total rental amount paid.
Pool/Spa Heat
If the guest elects to pay for either pool heat or spa usage or both then we will endeavor to ensure that the pool water temperature is maintained at 82 degrees and spa water will be heated to 100 degrees. However, these temperatures cannot be guaranteed as the temperature of the air is a major factor in heating the pools and spas. Sometimes things go wrong with pool water heating or filtration systems that are beyond our control. Should this occur we will do everything in our power to correct the situation. If we are unable to correct the fault due to mechanical breakdown of the heater/pump and/or related equipment within a reasonable time, we may refund a fair proportion of the price we have charged for defective service. Pool covers must be carefully removed before swimming and replaced immediately after use to help conserve heat and maintain the desired pool water temperature.
General Conditions
We cannot accept liability for acts or omissions over which we have no control. This includes (but is not limited to) airlines, car hire companies, management companies and for loss or damage caused by Force Majeure events such as strikes, fire, flood, delays or any other events beyond our control. Instructions and deposits taken by telephone and verbally confirmed are binding and will be subject to the same terms and conditions as written confirmations. All guests will be responsible for behaving in a responsible manner and in accordance with local regulations. The Diamond on the Island or the property owners cannot accept any liability for injury to guests or visitors to the homes or by use of swimming pools or for loss or damage to personal property howsoever caused. Check in time is 4 pm. Check out time is 10 am. Earlier check-in or late check-out is fully dependent on availability. Your completion of the booking form constitutes acceptance of the terms and conditions on behalf of the party booked. No pets or animals are allowed on or in the premises.
Liability
No liability is accepted by the owner or their Management Company whatsoever for death, personal injury, accidents, loss or damage to persons or personal effects however caused as a result of the use of the house or pool. This waiver extends to people visiting the house as guests or the guests(s). Tampering with the pool alarm is strictly forbidden and is there for the protection of all who use the house. Anyone tampering with or disconnecting pool alarms commit a misdemeanor of the second degree and this carries a prison sentence of (1) year or a fine of $5000.
Code of Conduct
Emerald Island Resort is a premier community and it is the guests responsibility to ensure that all community rules are followed and that guest behavior does not inconvenience your neighbors in any way. The Emerald Island Resort Community has strict rules and it is the guests responsibility to familiarize themselves with these guidelines including but not limited to minimal noise between the hours of 11:00pm and 8:00am. There is a maximum speed limit of 10 mph within the community. In the event that any member of your party behaves in a way that causes complaints or damage to property, the owners or their Property Management Companys representative reserve the right to terminate your contract immediately and all monies paid will be lost.
Force Majeure
Force Majeure means any circumstances which are unusual or unforeseeable and are outside Diamond on the Island control including (but not limited to) war or threat of war, riot, civil strife, hostilities, political unrest, government action or airport regulations, industrial dispute, natural or other disaster, nuclear incident, terrorist activity, weather conditions, technical problems with transportation, closure of airports, fire, flood, drought, temporary equipment failure in villas, apartments or hotels.
